New York Attorney General Letitia James has reached a settlement with Aneva Gym in Long Island City, resulting in refunds for customers and policy changes at the gym. The action follows a lawsuit filed by the Office of the Attorney General (OAG) in June 2025, which accused Aneva Gym of violating state laws designed to protect health club members.
The OAG alleged that Aneva Gym failed to provide written membership contracts and imposed cancellation policies that made it difficult for customers to end their memberships. As part of the settlement, Aneva Gym will update its cancellation policies to comply with New York law, offer restitution to affected customers, and pay a $5,000 penalty.
“Aneva Gym misled its customers, causing many to keep paying for gym memberships that they should have been able to easily cancel,” said Attorney General James. “Clear contracts and simple cancellation processes protect consumers. I will continue to enforce our laws to make sure businesses do not take advantage of New Yorkers.”
An investigation found that since opening in 2022, Aneva Gym did not follow several requirements under New York’s Health Club Services law. Instead of providing required written contracts, the gym posted terms on its website that were inconsistent with legal standards. For example, it required cancellations in writing and in person rather than allowing them via website, email, mail, telephone, or in person as mandated by law. The gym also demanded 30 days’ notice for cancellations when state law allows cancellations within three business days after a monthly renewal. Additionally, Aneva Gym had not posted a $50,000 bond with the Department of State—a requirement intended to protect consumers if a gym closes or fails to deliver services.
Under the court-submitted settlement agreement, Aneva Gym must now comply fully with all aspects of New York’s Health Club Services law. This includes providing compliant written contracts and updating its cancellation policies so members can cancel using multiple methods. The gym is also required to refund customers who faced issues cancelling their memberships and pay an additional $5,000 penalty. The required $50,000 bond has now been posted by Aneva Gym.
Attorney General James encourages anyone who had trouble cancelling their contract with Aneva Gym to file a consumer complaint online or contact the OAG hotline at (800) 771-7755. She also advises prospective health club members to verify whether clubs have posted the necessary financial security before joining; if not listed on the appropriate website, consumers are advised not to join and should file complaints both online with OAG and with the New York Department of State.
Attorney General James has previously taken action against other companies over similar issues regarding consumer rights related to contracts and subscription services.
