Attorney General James urges eligible DoorDash delivery workers to file claims before December deadline

New York Attorney General Letitia James is urging current and former DoorDash delivery workers who received notification of eligibility for a settlement to submit their claims before the deadline of December 31, 2025. In February 2025, Attorney General James secured $16.75 million from DoorDash after an investigation by the Office of the Attorney General (OAG) found that the company misled both consumers and its delivery workers, known as Dashers, by using tips intended for Dashers to subsidize their guaranteed pay.

Attorney General James has extended the claim submission deadline until December 31, 2025 at 11:59 PM. She encouraged all eligible Dashers who have received notification about the settlement to file their claims online before this date.

“Delivery workers keep this city running and deserve every dollar earned through their hard work,” said Attorney General James. “I encourage all eligible current and former Dashers to submit their claims right away so they can receive the compensation they are owed. My office will continue fighting to ensure all New York workers are treated with dignity and respect.”

Earlier this year, Attorney General James reached a historic agreement with DoorDash requiring the company to revise its payment practices, improve transparency for both customers and Dashers, and enhance access to order histories for Dashers. Individuals who worked for DoorDash in New York between May 2017 and September 2019—and whose tips were applied toward their guaranteed pay—are eligible to receive money from the settlement fund. The fund will be distributed among both current and former Dashers.

Eligible Dashers have been notified about the settlement by an independent administrator, Atticus Administration, via mail, email or text message. These notifications include instructions on how to submit a claim. According to Attorney General James’s office, those who have received notification but have not yet claimed or received restitution should file online as soon as possible. Approximately 63,000 delivery workers who delivered food for DoorDash in New York during the specified period are eligible for funds from this settlement; as of December 3rd, more than 30,000 claims had already been submitted.

Between 2017 and 2019, DoorDash used a guaranteed pay model that allowed Dashers to see potential earnings before accepting deliveries. Under this system, instead of providing customer tips in addition to guaranteed pay, DoorDash used tips to offset what it owed workers under its guarantee. The OAG investigation found that DoorDash misled customers into believing their tips would directly benefit drivers when in fact these amounts were deducted from guaranteed payments rather than added on top. Information about how tips were used was hidden in online documents inaccessible during key moments of ordering; customers were shown messages such as “Dashers always receive 100% of the tip,” but did not know that tips were reducing DoorDash’s own costs.
