The Office of Special Investigation (OSI) under New York Attorney General Letitia James released a report on Mar. 19 regarding the death of Jose Francisco Escobar Vasquez, who died after being struck by an off-duty Metropolitan Transportation Authority police officer’s vehicle in North Amityville, Suffolk County on March 15, 2025.
The release of this report is significant as it addresses public concerns about accountability and transparency when law enforcement officers are involved in fatal incidents. The OSI’s findings follow a detailed investigation into the circumstances surrounding Mr. Vasquez’s death.
According to the report, shortly after midnight on March 15, an off-duty MTA police officer was driving southbound on Route 110 when he struck Mr. Vasquez, who had entered the left southbound lane at an intersection without traffic signals or marked crosswalks. The area was dark and weather conditions were cold and rainy at the time of the incident. Mr. Vasquez was pronounced dead at the scene.
The OSI reviewed evidence including 911 calls, body-worn camera footage, security camera recordings, interviews with witnesses and experts, and conducted a legal analysis. The investigation found no evidence that the officer was speeding excessively—he was traveling between 43 and 47 miles per hour in a 40 mile per hour zone—or that he was distracted or impaired while driving. “In this case, there is no evidence that the officer was speeding, driving while distracted, impaired by drugs or alcohol, or otherwise driving in a dangerous manner,” according to the OSI report.
The office concluded that criminal charges were not warranted because prosecutors would not be able to prove beyond a reasonable doubt that the officer’s actions constituted criminally negligent homicide under New York law. “Therefore, OSI concluded that the evidence did not warrant criminal charges,” according to the report.
