A visually-impaired individual has filed a class action lawsuit against a prominent hydration company, alleging its website is inaccessible to blind users. The complaint was lodged by Mykayla Fagnani on November 18, 2025, in the United States District Court for the Southern District of New York against Buoy Hydration, Inc.
Fagnani, who is legally blind and requires screen-reading software to access digital content, claims that Buoy Hydration’s website fails to comply with the Americans with Disabilities Act (ADA) by not being fully accessible to visually-impaired individuals. The lawsuit highlights that this inaccessibility denies her and others like her equal access to the company’s products and services. According to the filing, “Defendant’s denial of full and equal access to its website…is a violation of Plaintiff’s rights under the ADA.” Fagnani points out several specific barriers she encountered while attempting to navigate the site using screen-reading technology, such as missing alternative text for images and broken links that hindered her ability to make purchases or gather information about products.
The plaintiff seeks a permanent injunction requiring Buoy Hydration to overhaul its web policies and practices to ensure compliance with accessibility standards like the Web Content Accessibility Guidelines (WCAG). This includes appointing a web accessibility consultant, conducting regular audits and training for employees involved in web development. Furthermore, Fagnani demands compensatory damages for herself and similarly affected individuals under various state laws including New York State Human Rights Law (NYSHRL), New York City Human Rights Law (NYCHRL), and General Business Law § 349 (GBL).
