Court warns creditors about third-party proof of claim filing offers

The U.S. Bankruptcy Court for the Southern District of New York has issued a notice to inform the public about recent reports involving creditors receiving mail from non-governmental agencies. These agencies are offering to file proofs of claim on behalf of creditors in exchange for a fee.

According to the court, creditors do not need to pay any fees to file a proof of claim. “Please be advised that creditors may electronically file a proof of claim pursuant to 11 U.S.C. § 501 and Fed. R. Bankr. P. 3002 for free using the ‘File A Proof of Claim’ link on the Court’s website at: https://www.nysb.uscourts.gov/electronic-filing-proof-claim,” the court stated.

The process does not require a login or password for CM/ECF when using the official online link provided by the court. Alternatively, creditors can submit their proofs of claim without charge by mailing or delivering them directly to the court.
