In a recent legal filing, Daniel Crosby, a legally blind resident of New York County, has initiated a class-action lawsuit against Factor 75, LLC. The case, filed in the United States District Court for the Southern District of New York, alleges that Factor 75’s website is not accessible to individuals with visual impairments, thereby violating the Americans with Disabilities Act (ADA). Crosby claims that despite using NonVisual Desktop Access (NVDA) screen reader software, he encountered numerous accessibility barriers on www.factor75.com. These issues included missing alternative text and unlabeled buttons which prevented him from completing transactions or accessing promotional offers. The lawsuit seeks injunctive relief to compel Factor 75 to make its website fully accessible and compliant with federal standards.
