U.S. Attorney Michael DiGiacomo announced the arrest of Segundo Juan Maynato-Guaman, also known as Segundo Juan Mainato-Guaman, a 46-year-old Ecuadorian citizen. He faces charges for re-entering the United States after being removed, a crime that could result in up to two years in prison and a $250,000 fine.

Assistant U.S. Attorney Nicholas M. Testani is handling the case. According to the complaint, on June 25, 2025, Rochester Border Patrol Agents stopped Maynato-Guaman’s vehicle at Brockport-Spencerport Road and Washington Street. When asked about his citizenship, he stated “Ecuador” and presented a New York State identification card with the name Segundo Mainato-Guaman. Upon further questioning about his legal status in the U.S., he admitted, “yes, I do not have any documents.” Records revealed that Maynato-Guaman was deported from the United States in December 2009.

This case is part of Operation Take Back America, an initiative by the Department of Justice aimed at addressing illegal immigration and dismantling cartels and transnational criminal organizations (TCOs). The operation combines resources from various programs including Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).

Maynato-Guaman appeared before U.S. Magistrate Judge Colleen D. Holland and was detained following his initial court appearance.

The investigation leading to this charge was conducted by U.S. Border Patrol under Patrol Agent-in-Charge Juan Ramirez Jr.’s direction.

It is important to note that being charged with a crime is an accusation; Maynato-Guaman remains presumed innocent until proven guilty.
