In a recent filing with the United States District Court for the Eastern District of New York, Nelson Uddin has lodged a complaint against Bivco, LLC, operating as Mercato Kitchen & Cocktails, and its owner Brian Bivona. Uddin, who worked as a waiter for the defendants from October 2022 to October 2023, alleges that he was not compensated fairly for his labor. The lawsuit seeks to recover unpaid overtime wages and minimum wages under both federal and state laws. Uddin claims that during his employment, he was paid $30 per seven-hour shift and $50 per twelve-hour shift but did not receive appropriate overtime pay or spread of hours compensation. The complaint accuses the defendants of failing to provide accurate wage notices and statements as required by law. Uddin is represented by The NHG Law Group, P.C., which is demanding compensatory damages, liquidated damages, statutory penalties, interest on unpaid wages, and attorneys’ fees.
