NYSBA president urges members to comment on DOJ attorney discipline proposal

Kathleen Marie Sweet, president of the New York State Bar Association, called on members to submit comments by April 6 regarding a proposed rule from the U.S. Department of Justice titled “Review of State Bar Complaints and Allegations Against Department of Justice Attorneys.”

The association said member input is important in shaping how federal authorities regulate attorney conduct and ensuring that legal professionals’ perspectives are considered in the rulemaking process.

Sweet said NYSBA has already filed a letter opposing the proposal, citing concerns that it conflicts with existing law and undermines the judiciary’s authority over attorney discipline. She encouraged members to review the proposal themselves and provide their own feedback. “The input and expertise of our members will play a significant role in shaping the rulemaking process and ensuring that the perspective of the legal profession is fully represented,” Sweet said.

According to Sweet, individual comments from practicing attorneys can help inform federal decision-makers about why independent, court-administered disciplinary systems should be preserved. She said this issue affects a core principle: all attorneys should follow uniform ethical rules under one disciplinary framework.
