The lawsuit alleges that the company’s website is not compatible with screen-reading software, thereby denying blind and visually-impaired individuals equal access to its online services.
According to the complaint, Fagnani requires screen-reading software to navigate websites due to her visual impairment. She contends that Boars Night Out LLC’s website lacks essential accessibility features such as alternative text for images and properly labeled links, which are necessary for screen readers to function effectively. This failure allegedly prevents visually-impaired users from accessing information about products like “Aces Wild The 4 Queens Seasoning,” which Fagnani attempted to purchase but was unable due to these barriers.
The lawsuit references a letter from U.S. Department of Justice Assistant Attorney General Stephen E. Boyd in 2018, affirming that public accommodations must ensure their websites are accessible under the ADA. Fagnani argues that Boars Night Out LLC’s non-compliance with these standards constitutes discrimination and increases isolation among disabled individuals. She seeks a permanent injunction requiring the company to implement changes ensuring their website meets Web Content Accessibility Guidelines (WCAG) 2.0 standards.
Fagnani’s legal team demands that Boars Night Out LLC hire a web accessibility consultant and provide regular training for employees involved in web development. They also request periodic audits and user testing by visually-impaired individuals to ensure ongoing compliance. Additionally, they seek compensatory damages, civil penalties under New York law, and coverage of attorney fees.
