Plaintiff alleges ADA violations by online retailer due to inaccessible website

In a compelling legal action, a visually-impaired individual has filed a class-action lawsuit against a company for failing to make its website accessible to blind and visually-impaired users. Cedric Bishop initiated the complaint on February 24, 2026, in the United States District Court for the Southern District of New York against Eden Partners LLC.

Cedric Bishop, who is legally blind and requires screen-reading software to access web content, claims that Eden Partners LLC has not designed or maintained its website in compliance with the Americans with Disabilities Act (ADA). This failure allegedly denies Bishop and others like him full access to the company’s online goods and services. The lawsuit references a letter from the U.S. Department of Justice affirming that websites must be accessible under ADA guidelines. Bishop’s complaint emphasizes that inaccessible websites exacerbate feelings of isolation among visually-impaired individuals and violate their civil rights under federal law.

The plaintiff argues that despite existing guidelines like the Web Content Accessibility Guidelines (WCAG) 2.0, which are widely adopted by businesses and government agencies to ensure accessibility, Eden Partners LLC’s website remains non-compliant. Bishop encountered multiple barriers when attempting to purchase products from Foria Botanicals’ online store operated by Eden Partners LLC. These barriers included missing alternative text for images, broken links, and other issues that prevented effective navigation using screen readers.

Bishop seeks a permanent injunction requiring Eden Partners LLC to overhaul its web accessibility policies and practices. The requested relief includes hiring an accessibility consultant, conducting regular audits and user testing with visually-impaired individuals, and implementing ongoing training for employees involved in web development. Additionally, Bishop seeks compensatory damages for himself and similarly affected individuals under New York State Human Rights Law, New York City Human Rights Law, and New York State General Business Law § 349.
