Plaintiff alleges construction firm CEO fostered hostile work environment

A former employee has filed a lawsuit against a prominent construction management company, alleging a pattern of sexual harassment and gender-based hostility. On December 5, 2025, Megan Mooney lodged her complaint in the United States District Court for the Southern District of New York against Richter & Ratner Contracting Corp. and its CEO, Marc Heiman.

The lawsuit details Mooney’s experience after being hired as Director of Growth and Partnerships on March 25, 2024. According to the complaint, Mooney was subjected to persistent sexual harassment by Heiman, who allegedly made inappropriate jokes about women “sleeping with clients” to secure business deals. The situation escalated when Heiman reportedly used his physical presence to intimidate Mooney further contributing to a hostile work environment. When Mooney reported these incidents, she faced severe retaliation that culminated in her termination on January 15, 2025—just one day after being notified of eligibility for EEOC mediation.

Mooney’s complaint outlines numerous instances of alleged misconduct by Heiman. On April 5, 2024, he responded to a casual greeting from Mooney with an explicit comment about making “earthquakes happen in bed.” Further allegations include derogatory remarks about female colleagues and racist comments towards Asian individuals. Despite reporting these issues to upper management and seeking a resolution for a safe working environment, Mooney claims that the company retaliated by restricting her access to office resources and scrutinizing her work excessively.

In her lawsuit, Mooney accuses Richter & Ratner and Heiman of violating Title VII of the Civil Rights Act of 1964, the New York State Human Rights Law (NYSHRL), and the New York City Human Rights Law (NYCHRL). She seeks various forms of relief including backpay, front pay, compensatory damages, punitive damages, attorneys’ fees, and costs associated with the case.
