Plaintiff alleges Enzo Custom Clothiers’ website discriminates against visually impaired users

Benjamin Butler, a legally blind resident of New York County, has filed a class action lawsuit against Enzo Custom Clothiers New York, Inc., alleging that the company’s website is inaccessible to visually impaired individuals. The complaint was filed on February 23, 2026, in the United States District Court for the Southern District of New York. Butler claims that Enzo Custom’s failure to make its website accessible violates Title III of the Americans with Disabilities Act (ADA).

The lawsuit details how Butler, who suffers from Retinitis Pigmentosa and relies on NonVisual Desktop Access (NVDA) screen reader software, attempted to shop for custom clothing on Enzo Custom’s website but encountered numerous accessibility barriers. These included missing alternative text on images, unlabeled interactive elements, and improper ARIA usage that rendered the site unusable for blind consumers. An accessibility audit conducted by SortSite confirmed these issues, identifying multiple violations of the Web Content Accessibility Guidelines (WCAG) 2.1 across the website.

Butler visited www.enzocustom.com three times in 2025 with the intent to purchase specific items such as a Loro Piana suit and related accessories but was unable to complete his transactions due to these barriers. He describes feeling frustrated and excluded by his inability to navigate the site independently. The lawsuit argues that Enzo Custom’s ongoing failure to provide an accessible digital platform constitutes discrimination under federal and state laws.

The plaintiff seeks injunctive relief requiring Enzo Custom to bring its website into compliance with ADA standards and ensure it remains accessible to blind users. Additionally, Butler requests compensatory damages for himself and other similarly affected individuals under New York State Human Rights Law and New York City Human Rights Law. The complaint also calls for punitive damages, civil penalties, attorney fees, and costs associated with the case.
