Plaintiff alleges former employer Hudson Hill Center for Rehabilitation discriminated based on religion

A former employee has filed a class-action lawsuit against her previous employer, accusing them of discrimination and unfair labor practices. On February 27, 2026, Mazal Ilyaich filed a complaint in the United States District Court for the Southern District of New York against Infinite Care Development, LLC, doing business as Hudson Hill Center for Rehabilitation and Nursing, and Daniel Spizer.

Mazal Ilyaich claims that during her employment from August 26, 2023, to August 21, 2024, she was subjected to discrimination based on her religion and national origin. The complaint details that the discriminatory behavior began when management discovered her romantic involvement with a Hispanic colleague. This revelation allegedly led to a change in attitude from her supervisor, Daniel Spizer, who is identified as an Orthodox Jewish male. According to Ilyaich’s allegations, Spizer objected to her relationship due to religious differences and subsequently ostracized her at work. She asserts that this treatment violated Title VII of the Civil Rights Act of 1964 and the New York State Human Rights Law.

The lawsuit also accuses the defendants of violating labor laws by misclassifying employees as independent contractors to avoid paying overtime wages. Ilyaich alleges she worked over forty hours per week but was not compensated appropriately for overtime. She argues that this practice contravenes both the Fair Labor Standards Act (FLSA) and New York Labor Law (NYLL). The plaintiff seeks compensatory damages for lost wages and emotional distress, liquidated damages under FLSA provisions, punitive damages for intentional misconduct under Title VII and NYSHRL, attorney fees, costs associated with litigation, and any other relief deemed appropriate by the court.

Ilyaich’s legal representation comes from Consumer Attorneys PLLC with Emanuel Kataev serving as counsel. The case is presided over by Judge [Name Not Provided] under Case ID: 7:26-cv-01642.
