A New York resident is taking legal action against two local businesses, claiming they have failed to accommodate her disability. Graciela Doncouse filed a complaint on November 17, 2025, in the United States District Court for the Southern District of New York against Pisces Bar & Tavern, Inc., and 541 Construction Corp. The lawsuit alleges that these entities have violated the Americans with Disabilities Act (ADA), along with state and city human rights laws, by not providing accessible facilities.
Doncouse, who uses a wheelchair due to paraplegia, attempted to visit Wakamba Bar—a well-known local dive bar operated by Pisces Bar—on July 5, 2025. She was unable to enter due to a step at the entrance that obstructed her path. “The existing barriers prevent access and restrict the paths of travel,” she stated in her complaint. Consequently, Doncouse was denied full and equal enjoyment of the services offered within the premises located at 543 8th Ave, New York City.
The plaintiff argues that both defendants are jointly responsible for maintaining accessible public accommodations as required by law. Despite previous lawsuits highlighting similar issues at this location—such as Florez v. Pisces Bar & Tavern Inc.—the establishments have allegedly failed to comply with ADA guidelines intentionally. Doncouse’s lawsuit outlines multiple violations including lack of an accessible route from public streets, inadequate dining tables and seating options for disabled individuals, inaccessible restrooms, and absence of proper signage.
Seeking redress from the court, Doncouse demands injunctive relief compelling immediate modifications to make the premises ADA-compliant. She also seeks compensatory damages for discrimination suffered due to her disability under federal and state laws. The plaintiff emphasizes that without such changes, she continues to be deterred from visiting Wakamba Bar despite its proximity to her home and its appeal as a bilingual venue offering Spanish-speaking events.
Represented by The Marks Law Firm P.C., Doncouse requests declaratory judgment confirming the defendants’ violations of accessibility laws.
