Plaintiff Alleges Local Gift Shop Businesses Violate Disability Access Laws

A New York resident has taken legal action against two local businesses, alleging discrimination based on disability. Graciela Doncouse filed a complaint in the United States District Court for the Southern District of New York on February 22, 2026, accusing 555 NY Souvenir & Gift Inc. and Sloyer-Forman, Inc. of failing to provide accessible facilities for individuals with disabilities at their premises located at 555 8th Avenue Street, New York.

The lawsuit centers around allegations that the defendants’ premises are not compliant with the Americans with Disabilities Act (ADA), as well as state and city human rights laws. Doncouse, who is paraplegic and uses a wheelchair, claims she was unable to access the gift shop due to barriers such as steps leading to the entrance. She asserts that these obstacles have denied her “full and equal access” to the store’s offerings and services. The complaint details how Doncouse attempted to visit the store on July 16, 2025, but was met with inaccessible pathways and lack of assistance from staff.

Doncouse’s legal team argues that both companies have violated multiple provisions under federal and local laws by maintaining an environment that discriminates against disabled individuals. They point out specific violations such as non-compliant service counters and inadequate signage within the store. Furthermore, they allege that despite being aware of these issues, the defendants have failed to make necessary modifications to accommodate disabled patrons.

In seeking justice, Doncouse requests various forms of relief from the court. These include a declaratory judgment stating that the defendants are in violation of ADA standards, a permanent injunction mandating immediate alterations to ensure accessibility, compensatory damages for past discrimination suffered, and coverage of attorney fees and related costs.
