In a landmark legal battle, a visually-impaired individual has filed a class action lawsuit against a major logistics company for allegedly failing to make its website accessible to people with disabilities. The complaint was lodged by Mykayla Fagnani on November 24, 2025, in the United States District Court for the Southern District of New York against United Parcel Service, Inc. (UPS). The lawsuit accuses UPS of violating the Americans with Disabilities Act (ADA) by not ensuring its website is usable by individuals who rely on screen-reading software.
The plaintiff, Mykayla Fagnani, claims that she and others similarly situated have been denied full and equal access to UPS’s services due to the company’s failure to design and maintain an accessible website. According to the complaint, Fagnani is legally blind and requires screen-reading software to navigate online content. However, she encountered multiple barriers while attempting to use UPS’s website, such as missing alternative text for images and broken links that hindered her ability to ship packages or access essential information about UPS’s services.
Fagnani argues that these accessibility issues violate her rights under the ADA, which mandates that public accommodations provide equal access to individuals with disabilities. The lawsuit cites a letter from the U.S. Department of Justice affirming that websites must be accessible under the ADA. Furthermore, it highlights how inaccessible web content can exclude people with disabilities just as much as physical barriers at store entrances.
The plaintiff seeks a permanent injunction requiring UPS to implement changes that would make its website fully accessible. This includes hiring a qualified consultant to improve web accessibility, conducting regular audits and user testing with visually-impaired individuals, and modifying corporate policies related to digital accessibility. Additionally, Fagnani demands compensatory damages for herself and other affected individuals under New York State Human Rights Law and New York City Human Rights Law.
