Plaintiff Alleges Luxury Retailer Website Violates ADA Accessibility Standards

A visually-impaired individual has filed a lawsuit against a luxury retail company, alleging that its website is inaccessible to blind and visually-impaired users. The complaint was filed by Edery Herrera on February 2, 2026, in the United States District Court for the Southern District of New York against Serena Uziyel LLC.

The plaintiff, Edery Herrera, claims that Serena Uziyel LLC’s website fails to comply with the Americans with Disabilities Act (ADA) by not being accessible to individuals who rely on screen-reading software. Herrera argues that this inaccessibility denies him and others like him full and equal access to the goods and services offered by the defendant’s online platform. According to the complaint, Herrera attempted to purchase a product from the website but encountered multiple barriers that prevented him from completing his transaction. These barriers included broken links, missing alternative text for images, and other accessibility issues that hindered his ability to navigate the site effectively.

The lawsuit cites several legal precedents and guidelines, including the Web Content Accessibility Guidelines (WCAG) 2.0, which provide standards for making web content accessible to people with disabilities. The plaintiff asserts that despite these established guidelines, Serena Uziyel LLC has failed to implement necessary changes to make its website accessible. The complaint further highlights how inaccessible websites contribute to a sense of isolation among visually-impaired individuals and violate their civil rights under both federal and state laws.

Herrera seeks a permanent injunction requiring Serena Uziyel LLC to make its website fully accessible by adopting comprehensive policies and procedures in line with WCAG 2.0 standards. This includes hiring a qualified consultant to oversee accessibility improvements, conducting regular audits and user testing with visually-impaired individuals, and providing training for employees involved in web development. Additionally, Herrera is seeking compensatory damages for violations of civil rights under New York State Human Rights Law and New York City Human Rights Law.
