Plaintiff Alleges Major Healthcare Provider’s Websites Violate ADA Accessibility Standards

A legally blind woman has filed a class-action lawsuit against a prominent health and wellness company, accusing it of violating the Americans with Disabilities Act (ADA) by failing to make its websites accessible to visually impaired users. Angel Jenkins, who is legally blind due to Endophthalmitis from a vehicular accident, lodged the complaint on January 30, 2026, in the United States District Court for the Southern District of New York against Hims & Hers Health, Inc.

The lawsuit alleges that Hims & Hers Health, Inc., which operates e-commerce platforms www.hims.com and www.forhers.com, has not ensured its websites are accessible to blind and visually impaired individuals. These platforms offer various health and wellness products along with telehealth services. Jenkins claims that she relies on screen-reading software like NVDA or JAWS to navigate digital content but encountered significant accessibility barriers when attempting to use these sites. The barriers included issues such as videos without pause controls, images with non-descriptive alt-texts, and ARIA controls lacking labels. “These violations of WCAG 2.1 Level AA standards render the site inaccessible to blind users,” Jenkins states in her complaint.

Jenkins argues that these failures deny her equal access to critical health-related information and support services provided by Hims & Hers Health, Inc., thus violating Title III of the ADA. The lawsuit also cites violations under New York State Human Rights Law and New York City Human Rights Law for failing to accommodate persons with disabilities adequately. According to Jenkins’ legal team from Joseph & Norinsberg LLC, approximately 8.1 million people in the U.S. are visually impaired, highlighting the widespread impact of such accessibility issues.

Jenkins seeks a preliminary and permanent injunction requiring Hims & Hers Health, Inc., to make their websites fully compliant with ADA requirements so they are accessible and usable by blind individuals. Additionally, she requests compensatory damages for herself and others similarly affected by these alleged violations of civil rights under state laws.
