Plaintiff Alleges Restaurant Operator Violates ADA Accessibility Standards

In a compelling legal battle that underscores the ongoing struggle for accessibility rights, a Brooklyn resident has filed a lawsuit against two New York-based companies, alleging violations of the Americans with Disabilities Act (ADA). The complaint was lodged by Joshua Adams in the United States District Court for the Southern District of New York on February 20, 2026, targeting defendants 315 W 46 LLC and Kim & Wei Holding LLC.

Joshua Adams, who was born with spina bifida and hydrocephalus and relies on a wheelchair for mobility, claims that he encountered significant barriers when attempting to access Kyuramen, a restaurant located at 315 W 46th St Floor 1 in New York City. Despite his interest in enjoying the restaurant’s Japanese cuisine, Adams alleges that architectural obstacles such as descending concrete stairs and lack of accessible routes prevented him from entering the establishment. He recounts an incident where he waited outside the restaurant only to be informed by an employee that no portable ramp was available to facilitate his entry. This experience left him feeling discriminated against and unable to partake in the dining experience offered by Kyuramen.

The lawsuit accuses both defendants of failing to comply with Title III of the ADA, which mandates public accommodations to provide full and equal enjoyment of their goods and services to individuals with disabilities. According to Adams’ complaint, several ADA violations were identified at the premises, including inaccessible entrances, non-compliant service counters, and inadequate restroom facilities. These barriers allegedly hindered not only Adams but also other individuals with similar disabilities from accessing the restaurant.

Adams is seeking injunctive relief from the court, demanding that the defendants make necessary modifications to bring their property into compliance with ADA standards. This includes removing physical barriers and ensuring all facilities are accessible to people with disabilities. Furthermore, Adams requests that Kyuramen be closed until these changes are implemented. In addition to structural changes, he seeks compensation for attorney’s fees and litigation expenses incurred during this legal process.
