A New York resident is taking legal action against two businesses, alleging that they have failed to comply with the Americans with Disabilities Act (ADA), thus denying him access to their premises. Joshua Adams filed a complaint in the United States District Court for the Southern District of New York on February 26, 2026, against Kailash Partners 7 LLC and Food Affairs Inc.
Joshua Adams, who resides in Brooklyn and uses a wheelchair due to spina bifida and Hydrocephalus, claims that his attempts to patronize Spice Symphony—a restaurant owned by Food Affairs Inc. and located at a property managed by Kailash Partners 7 LLC—were thwarted by significant accessibility barriers. According to the complaint, these barriers include descending brick stairs at the entrance without proper ramp access, inadequate handrails, non-compliant restroom facilities, and inaccessible dining surfaces. On multiple occasions in 2025 and as recently as February 4, 2026, Adams encountered these obstacles which prevented him from enjoying the restaurant’s offerings.
The lawsuit outlines how an employee of Spice Symphony suggested that Adams should have called ahead for a temporary ramp—a makeshift solution involving three thin wooden boards—which was deemed unsafe for use with his wheelchair. This interaction left Adams unable to enter the establishment despite his intentions to dine there. The complaint accuses both defendants of willful discrimination under Title III of the ADA by maintaining structural barriers and failing to provide equal access to individuals with disabilities.
Adams seeks injunctive relief requiring the defendants to bring their premises into full compliance with ADA standards. This includes removing all physical barriers and making necessary modifications to ensure accessibility for individuals with disabilities. Additionally, he requests that the court award him reasonable attorney’s fees, costs, and expenses incurred during this litigation.
