A lawsuit has been filed in the Southern District of New York, accusing a local restaurant and its property owner of violating the Americans with Disabilities Act (ADA). Joshua Adams, the plaintiff, initiated this legal action on February 18, 2026, against Kailash Partners 3 LLC and Gurume Restaurant Group LLC. The complaint highlights numerous accessibility barriers at the restaurant’s premises that allegedly infringe upon federal disability rights laws.

Joshua Adams, a resident of Brooklyn who uses a wheelchair due to spina bifida and hydrocephalus, claims he encountered significant obstacles when attempting to access Gurume Tapas Bar located at 313 W 46th St in New York City. The lawsuit details his experiences during visits in 2025 and most recently on February 4, 2026. Adams describes how concrete stairs at the entrance posed an insurmountable barrier for him, compounded by the absence of any signage or bell indicating accessible entry. He recounts waiting for assistance from staff members who noticed him but failed to offer help or service.

The complaint accuses Kailash Partners 3 LLC and Gurume Restaurant Group LLC of maintaining discriminatory practices by not providing necessary accommodations as mandated by Title III of the ADA. Adams argues that these actions reflect a deliberate indifference to his rights and those of similarly situated individuals with disabilities. Despite frequenting the neighborhood for personal and professional reasons, Adams states he is unable to enjoy dining at Gurume Tapas Bar due to these accessibility issues.

Adams seeks injunctive relief from the court, demanding that the defendants bring their premises into full compliance with ADA standards. This includes removing physical barriers such as inaccessible entrances and non-compliant restroom facilities. The lawsuit also requests that Gurume Tapas Bar be closed until these modifications are completed. Additionally, Adams is pursuing compensation for attorney’s fees and litigation costs incurred during this legal process.
