Superfoods Accused by Consumer Group Over Contaminated Dietary Supplements

A class action lawsuit has been filed against a dietary supplement manufacturer following a recall due to potential Salmonella contamination. The complaint, submitted by Charlyn Adkins on February 2, 2026, in the United States District Court for the Southern District of New York, targets Superfoods, Inc., doing business as Live It Up. This legal action underscores the severity of the health risks posed by contaminated supplements and highlights consumer protection issues.

The case revolves around allegations that Superfoods misrepresented its products as being of high quality and safe for consumption while failing to disclose potential contamination with Salmonella. On January 15, 2026, Superfoods announced a recall of several batches of its Live It Up Super Greens products due to possible Salmonella contamination. The recall affected various product forms and flavors sold across the United States since September 2024 through direct sales and online platforms like Amazon.com. According to the complaint, this contamination has resulted in at least 45 illnesses and 12 hospitalizations nationwide.

Plaintiff Charlyn Adkins claims she suffered severe stomach cramps consistent with Salmonella poisoning after consuming the recalled product in December 2025. She incurred significant medical expenses due to her illness. The lawsuit accuses Superfoods of negligence, negligent misrepresentation, breach of express and implied warranties, fraudulent concealment, violation of state consumer protection acts, strict product liability, and unjust enrichment. Adkins argues that consumers would not have purchased these products had they been aware of the contamination risk.

The plaintiffs seek compensatory damages exceeding $5 million and other reliefs such as punitive damages, restitution, disgorgement of profits obtained through alleged deceptive practices, and an injunction preventing further sale of contaminated products. They also demand coverage for legal fees and costs associated with prosecuting this action.
