A visually-impaired individual has taken legal action against a prominent candy retailer, accusing the company of failing to make its website accessible to blind and visually-impaired users. On November 20, 2025, Mykayla Fagnani filed a class-action complaint in the United States District Court for the Southern District of New York against Sugarfina USA LLC. The lawsuit claims that Sugarfina’s website is not compatible with screen-reading software, thereby violating the Americans with Disabilities Act (ADA) and other state laws.
The complaint highlights that Mykayla Fagnani, who requires screen-reading software to access web content, encountered multiple barriers when attempting to use Sugarfina’s website. These barriers included broken links, images without alternative text descriptions, and inaccessible forms. As a result, Fagnani was unable to complete transactions or access information about products such as vegan candies. The lawsuit references guidelines from the World Wide Web Consortium (W3C) that are widely recognized for making websites accessible to individuals with disabilities. It argues that Sugarfina’s failure to adhere to these guidelines constitutes discrimination under the ADA and similar state laws.
Fagnani seeks a permanent injunction requiring Sugarfina to make its website fully accessible by implementing specific measures such as hiring a web accessibility consultant and conducting regular audits. Additionally, she demands compensatory damages for herself and other similarly affected individuals, along with attorney fees and costs associated with monitoring compliance. The case also calls for declaratory relief affirming that Sugarfina’s practices violate both federal and state disability rights laws.
