In a lawsuit filed in the United States District Court for the Eastern District of New York, Yolanda Rodriguez, acting as the mother and natural guardian of her minor child A.M.R., has accused the Hempstead Union Free School District and several of its officials of gross negligence leading to the sexual assault of A.M.R. on school grounds. The complaint alleges that due to inadequate supervision by school staff, A.M.R., a student with disabilities, was assaulted by a classmate. Following the incident, rather than supporting A.M.R., school officials allegedly retaliated by suspending him for one month. The lawsuit claims violations under various federal and state laws including the Individuals with Disabilities Education Act (IDEA), Americans with Disabilities Act (ADA), Rehabilitation Act, and Title VII of the Civil Rights Act. The plaintiff seeks compensatory and punitive damages along with attorneys’ fees.
